1 – General
The General Terms and Conditions (hereinafter referred to as GTC) apply to all products and services purchased via WUN GMBH – ROSENBAER.CH. This also includes delivery.
The order becomes binding for the buyer when it is finally sent. With the execution of the order, the GTC shall be deemed accepted.
General Terms and Conditions of Purchase of the Buyer are hereby expressly rejected.
The place of jurisdiction is the registered office of WUN GMBH – ROSENBAER.CH, 8005 Zurich. The contract is subject to Swiss law.
2 – Offer
WUN GMBH – ROSENBAER.CH excludes all liability for the products sold and delivered to the extent permitted by law.
All products are not suitable for children under 3 years of age.
The offer of WUN GMBH – ROSENBAER.CH is aimed exclusively at customers with their place of residence or registered office in Switzerland (CHE). Deliveries are made exclusively to addresses in Switzerland and the Principality of Liechtenstein. In specially agreed exceptions, deliveries are also made to other countries.
All items are dispatched from our warehouse in Zurich, subject to exceptions.
The product details on WUN GMBH – ROSENBAER.CH (photos, illustrations, dimensions, weights, etc.) are for guidance only. This information is generally obtained directly from the manufacturers. For this reason, no liability can be accepted for the accuracy, completeness and up-to-dateness of the product information. WUN GMBH – ROSENBAER.CH always endeavors to provide correct product information.
WUN GMBH – ROSENBAER.CH reserves the right to change prices and product ranges at any time.
3 – Prices
The sales prices published on WUN GMBH – ROSENBAER.CH are authoritative. All prices are in Swiss francs (CHF).
4 – Minimum order value
There is no minimum order value. For orders under CHF 15, we charge a small quantity surcharge of CHF 8.
5 – Delivery
Your order will be carefully packed. Delivery will be made from our warehouse in Zurich and will be sent by Swiss Post.
If possible, delivery will be made immediately, but at the latest within 24 hours (on working days).
Dates and delivery periods are non-binding, unless expressly agreed otherwise in writing. The indication of specific delivery periods and delivery dates by WUN GMBH – ROSENBAER.CH is subject to correct and timely delivery by suppliers and manufacturers.
WUN GMBH – ROSENBAER.CH is entitled to make partial deliveries.
6 – Shipping and collection costs
The shipping and any collection costs are listed in the order.
We charge an additional collection fee of CHF 5 for collections in the time windows from 09:00 to 10:00 and from 20:00 to 22:00 and for collections on Sundays. This surcharge can be seen when selecting the time slot in the order process.
7 – Transfer of risk
Delivery is at the risk of the recipient.
The goods must be checked for correctness, completeness and intactness immediately upon arrival. Transport damage must be reported and documented immediately, at the latest two calendar days after receipt of the goods.
The risk is transferred to the buyer as soon as the shipment has been handed over to the person carrying out the transport. If shipment is delayed or becomes impossible through no fault of WUN GMBH – ROSENBAER.CH, the risk shall pass to the buyer upon notification of readiness for shipment.
Visible differences in quantity must be reported to the carrier in writing immediately upon receipt of the goods. Hidden differences in quantity must be reported to WUN GMBH – ROSENBAER.CH immediately upon receipt of the consignment. Any other complaints must also be reported immediately.
8 – Terms of payment
If payment is made by Twint, PostFinance Card or credit card, the amount will be debited when the order is placed.
If payment is made in advance by bank transfer, delivery will only be made after receipt of payment.
If “payment on collection” is selected (if offered), WUN GMBH – ROSENBAER.CH reserves the right to make goods available only when the customer is present.
Payment shall only be deemed to have been made when WUN GMBH – ROSENBAER.CH can dispose of the amount.
9 – Retention of title
The delivered goods remain the property of WUN GMBH – ROSENBAER.CH until full payment has been received.
In the event of late payment, WUN GMBH – ROSENBAER.CH shall be entitled to charge default interest at the usual bank rate in addition to reminder fees.
For the duration of the delay, WUN GMBH – ROSENBAER.CH is also entitled to withdraw from the contract at any time, to demand the return of the delivered goods and to claim compensation for the loss of the contract.
All claims shall become due immediately if the customer is in default of payment, culpably fails to comply with other essential obligations arising from the contract or if WUN GMBH – ROSENBAER.CH becomes aware of circumstances which are likely to reduce the creditworthiness of the customer, in particular suspension of payments, pendency of composition or bankruptcy proceedings.
In such cases, WUN GMBH – ROSENBAER.CH shall be entitled to withhold outstanding deliveries or to execute them only against advance payment or securities.
WUN GMBH – ROSENBAER.CH reserves the right to demand advance payment or payment by credit card.
Claims for damages arising from impossibility of performance, from breach of contract, from culpa in contrahendo and from tort are excluded both against WUN GMBH – ROSENBAER.CH and against our vicarious agents, except in cases of willful misconduct or gross negligence.
No liability is accepted for consequential damage resulting from the use of the products.
10 – Returns
It is generally not possible to return items from WUN GMBH – ROSENBAER.CH.
For returns of defective products, WUN GMBH – ROSENBAER.CH requires that the defective product be returned to WUN GMBH – ROSENBAER.CH, Heinrichstrasse 225, 8005 Zurich, within a maximum of 3-4 days.
Returns must be accompanied by a copy of the invoice or delivery bill.
Products that we procure at the customer’s request cannot be returned.
WUN GMBH – ROSENBAER.CH will not bear the postage costs for returns.
11 – Liability
WUN GMBH – ROSENBAER.CH excludes all liability for the products sold and delivered to the extent permitted by law.
WUN GMBH – ROSENBAER.CH accepts no responsibility for the currency, accuracy or completeness of the information provided in the online store.
Liability claims against WUN GMBH – ROSENBAER.CH relating to material or non-material damage caused by the use or non-use of the information and products provided or by the use of incorrect or incomplete information and products are fundamentally excluded.
All offers are subject to change and non-binding.

13 – Data protection & storage
The collection and processing of personal data by WUN GMBH – ROSENBAER.CH is governed by the provisions of the Swiss Data Protection Act (DSG).
No permanent customer accounts are created. Orders are placed exclusively as a guest. The data entered by the customer will only be used to process the order, delivery and invoicing.
Due to legal regulations (Art. 958f OR), WUN GMBH – ROSENBAER.CH is obliged to keep business records and accounting documents (including invoices, order confirmations and the transaction data contained therein) for at least 10 years. This data will be deleted after expiry of the statutory retention period, provided there are no further legal obligations.
The customer has the right to information about the personal data stored about them at any time and, after expiry of the statutory retention periods, to its deletion.
Personal customer data is treated confidentially and not passed on to uninvolved third parties, unless this is necessary for the provision of services (e.g. post/forwarding agent for delivery or debt collection service providers for credit checks).
